These terms govern your use of the Colour Memory API, MCP server, website, and related services. By using any Colour Memory service you agree to these terms.
1. Who We Are
Colour Memory is a product of PR Eye Ltd, registered in England and Wales. The service is operated by Digby Oldridge trading as PR Eye Ltd, Oxfordshire, UK.
UK trademark UK00004387450 covers COLOUR MEMORY in Classes 9, 35, and 42.

2. The Service
Colour Memory provides a colour intelligence API and MCP server giving access to approximately 15,000+ named colours drawn from historical, cultural, scientific, and artistic archives. The service is offered on a subscription basis with a free trial tier.
We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will give reasonable notice of material changes where possible.
3. Accounts and API Keys
Access to the API requires an API key issued upon registration. You are responsible for:
- Keeping your API key secure and confidential
- All activity that occurs under your key
- Notifying us immediately if you suspect unauthorised use
We may suspend or revoke keys that are shared, resold, or used in breach of these terms without prior notice.
4. Acceptable Use
You may use Colour Memory for any lawful purpose. You must not:
- Attempt to reverse engineer, scrape, or bulk-export the full archive
- Resell or sublicense API access without written agreement
- Use the service to build a competing colour archive or API product
- Exceed your tier's call limits by any means, including rotating keys
- Use the service in ways that damage, overload, or impair our infrastructure
- Misrepresent the source of colour data returned by the API
- Use data returned by the API to train, fine-tune, or otherwise build machine learning models, neural networks, or AI systems — including colour intelligence, colour archive, or colour naming systems — without a separate written licence from PR Eye Ltd
- Store, cache, or systematically collect API responses in a way that replicates or approximates the archive as a dataset, whether for internal use or otherwise
We reserve the right to terminate access for any use we deem harmful to the service or its users.
5. Subscriptions and Payment
Paid subscriptions are billed monthly via Stripe. Prices are in GBP and listed on the pricing page. Founding rates are available for a limited period and are subject to change.
Trial keys are provided free with no payment required. Trial keys are limited to 50 API calls and are intended for evaluation only.
Refunds are not automatically provided for unused calls within a billing period. If you believe you have been charged in error, contact us within 14 days and we will investigate.
6. Intellectual Property
The Colour Memory archive, naming system, colour provenance records, and API infrastructure are the intellectual property of PR Eye Ltd. The trademark COLOUR MEMORY is registered in the UK (UK00004387450, Classes 9, 35, 42).
Data returned by the API may be used in your own products and services subject to these terms. You must not present the archive data as your own original work or remove attribution.
Historical colour names, sources, and cultural notes are drawn from public domain references. PR Eye Ltd makes no claim over the underlying historical facts, only over the compilation, curation, and presentation.
7. Availability and Accuracy
We aim for high availability but do not guarantee uninterrupted service. The API is hosted on Railway and is subject to their infrastructure availability.
Colour values in the archive are derived computationally from reference sources and are not spectrophotometrically measured. They are provided for creative, research, and informational purposes. We make no warranty that they are suitable for colour-critical professional applications such as print production or paint specification without independent verification.
8. Limitation of Liability
To the maximum extent permitted by law, PR Eye Ltd is not liable for any indirect, incidental, or consequential loss arising from your use of the service, including but not limited to loss of revenue, data, or business opportunity.
Our total liability to you in any 12-month period shall not exceed the amount you paid us in that period.
9. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
10. Changes to These Terms
We may update these terms as the service evolves. We will notify registered users of material changes by email where possible. Continued use of the service after changes are posted constitutes acceptance of the revised terms.
